Conditions Relating to the Sale of Products
This section deals with conditions relating to the sale of products, outside France, Monaco and Andorra, by www.miss-golf-boutique.com to you. For conditions related to France, Monaco and Adorra, please see our “conditions de vente” by clicking on the french flag on the right side of your screen.
1. Our contract
When you place an order to purchase a product from www.miss-golf-boutique.com, we will send you an e-mail confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a product which is accepted by us when we send e-mail confirmation to you that we've processed the order (the "Order process E-mail"). That acceptance will be complete at the time we send the Order process E-mail to you. Any products on the same order which we have not confirmed in a Order Process E-mail to have been dispatched do not form part of that contract.
2. Returns
Customers in the European Union are entitled to a statutory cooling-off period of seven business days. We add 7 days to this delay to let you change your mind, with no explanation. We want you to be totally satisfied with every purchase you make from us. It is our aim to offer you value and quality. So if, for any reason, you are not completely happy with your purchase, simply follow the returns procedure below and return the goods within 15 working days of delivery unused in its original packaging together with the receipt. We'll exchange it or offer you a refund. Custom fitted clubs are excluded from the 15 Day Money Back Guarantee and from the EU statutory 7 days cooling-off period.
Please note in the event when goods are returned for refund or exchange, all delivery charges that have already incurred will be retained before passing credit. We offer outstanding value in the products that we sell by having a discounted shipping structure. However in order to maintain such low prices and top service, we do not offer a refund on the delivery cost if an order is returned and the fault is not of www.miss-golf-boutique.com. If an item is to be exchanged, delivery costs will be charged to you. We will advise you the cost of return during the exchange confirmation. Your statutory rights are unaffected.
In addition, technical products are guaranteed against manufacturing defects for a minimum of 12 months (return to base). If you require return of a product due to a fault or manufacturing defect within the first 12 months, you may also complete the Returns procedure given below. You may send back the faulty/defective goods at your own cost or you may contact us for a quote for collection. A free delivery is normally offered for the replacement back to you. If the cost of replacement is not cost-effective, we shall refund you for the value of the returned-goods with your consent.
To return a product you need to obtain a Return Merchandise Authorization (RMA) number. You need to apply for an RMA Request to return any incorrectly supplied/faulty or damaged items. NO returns of any type will be accepted without an RMA number. Please follow the simple procedure given below to apply for an RMA:
1. Send us an email through the contact form. In the body of your message, ask for a RMA number and give the order number and product reference. Tell us what action you want : exchange or refund. 2. A unique RMA reference number will be issued to you. Please note this number down as you may require it for future correspondence. An email confirmation will also follow with the RMA details. 3. To prevent any confusion, we do not ship out any replacements until the goods have been received back to our warehouse for returns-processing. However if faulty goods have been received and replacements are urgent then we may arrange to ship out a replacement product (if in stock). Please note for such scenarios the customer will be required to pay the full amount for the replacement goods whilst the faulty product is on its way to us, and upon receipt of the faulty product a full refund will be passed for the new amount paid. 4. Your request is sent to our Returns Team who will then reply by e-mail and inform you of the outcome. Do not ship the good before our Returns Team has accepted the return. 5. Once the return has been accepted, please address the goods to the address provided in our correspondence
PS: We strongly advise you to use a recorded or traceable courier service when sending the parcel back to us as we cannot be held responsible for goods that are lost in transit. Please contact us if you require further assistance.
3. Pricing and availability
We list availability information for products sold by us on the website, including on each product information page. Beyond what we say on that page or otherwise on the website, we cannot be more specific about availability. Please note that dispatch estimates are just that. They are not guaranteed dispatch times and should not be relied upon as such. As we process your order, we will inform you by e-mail if any products you order turn out to be unavailable.
4. Delivery
With the standard shipment option, most orders are delivered within 1 week to your door. For the express shipment, the delivery is made within 3 days. Please note for most items the recipient is required to sign for the goods on delivery. Should there be any unexpected further delay, we will notify you at the earliest (and you can cancel your order at any time if the delay is unacceptable to you). You can contact us to get parcel tracking information. Please note that the delivery times mentioned here are only a guide and therefore they may vary with different addresses and postcodes. Please note although every effort is made to deliver goods on time/date specified delays may still take place under situations beyond our control for e.g. bad weather conditions, severe traffic problems, sorting errors, loss/stolen goods etc. Once the goods have been collected from our premises by the courier, we no longer have any control of the delivery of the goods. Although courier problems happen rarely we cannot be held responsible for the late delivery of an item. For the avoidance of doubt, www.miss-golf-boutique.com will not refund the standard delivery charge if the courier has failed to deliver the item(s) on the anticipated delivery date. The couriers work at a 95-98% efficiency level for completing deliveries on time, therefore it is a good possibility that goods will be delivered on time specified. Important Stock Information In the rare events when certain item(s) in your order runs out of stock, for instance overnight orders or simultaneous orders, and we are unable to dispatch your goods to you, we shall contact you via e-mail/telephone to advise you of the situation. You will of course have the option to cancel your order at this point or opt for an alternative option if available.
4. Customs
When ordering goods from www.miss-golf-boutique.com for delivery outside the EU you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering from www.miss-golf-boutique.com, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods. Your privacy is important to us and we know that you care about how information about your order is used and shared. We would like our international customers and customers dispatching products internationally to be aware that cross-border deliveries are subject to opening and inspection by customs authorities.
5. Alteration of Service or Amendments to the Conditions
We reserve the right to make changes to our website, policies, and these Conditions of Sale at any time. You will be subject to the policies and Conditions of Conditions of Sale in force at the time that you use the website or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition 6. Events beyond our reasonable control We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights. 7. Waiver If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions. 8. Governing law and jurisdiction These conditions are governed by and construed in accordance with the French laws and the application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. 9. 6. Privacy Statement
We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998). We collect information about you for two reasons: firstly, to process your order and second, to provide you with the best possible service. We do not sell any information about our customers. We will not forward your details on to any third party at any time. If you agree to join our mailing list then we use the e-mail address you supply, to inform you of updated product information and special offers. If we send you an e-mail in the future, we will give you the chance to refuse any further marketing email from us or from another trader in the future. We do not send random marketing emails to personal email addresses (spam).
We will never collect sensitive information about you without your explicit consent. The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly.
